![]() ![]() Section 59(1) of the Sentencing Code provides that: It applies to all offenders aged 18 and older, who are sentenced on or after the effective date of this guideline, regardless of the date of the offence.* In accordance with section 120 of the Coroners and Justice Act 2009, the Sentencing Council issues this definitive guideline. It provides guidance which sentencers are encouraged to take into account wherever applicable, to ensure that there is fairness for all involved in court proceedings. Guideline users should be aware that the Equal Treatment Bench Book covers important aspects of fair treatment and disparity of outcomes for different groups in the criminal justice system. This offence is subject to statutory minimum sentencing provisions. Offence range: Band A fine – 8 years’ custody Offence range: Discharge – 8 years’ custody Offence range: Band B fine – 10 years’ custody Maximum: 14 years’ custody and/ or unlimited fine Offence range: High level community order – 16 years’ custody Triable either way unless the defendant could receive the minimum sentence of seven years for a third drug trafficking offence under section 313 of the Sentencing Code in which case the offence is triable only on indictment.
